Terms of Service

You must be at least 16 years old to use the Service. By using WODBuilders, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

WODBuilders provides an automated CrossFit workout (WOD) generation platform. The Service allows users to generate personalized workout programs based on fitness level, available equipment, and duration preferences. The Service includes:

• Automated WOD generation (AMRAP, EMOM, For Time, Chipper, Tabata formats)
• Daily workout of the day (WOD) published at a permanent URL
• SEO-optimized workout pages by format and equipment
• User accounts with saved workouts and profile preferences
• Subscription-based Pro features (where applicable)

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account at legal@wodbuilders.com
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

Exercise carries inherent risks. By using the Service, you acknowledge that:

• You participate in all workouts at your own risk
• You are physically capable of performing the exercises described
• WODBuilders is not responsible for any injuries, health complications, or adverse effects resulting from following generated workouts
• Generated workouts are algorithmic and not tailored by a certified professional for your specific medical situation
• You should always warm up, cool down, and use proper form

WODBuilders offers both free and paid subscription tiers:

• Free Plan: Limited to 5 WOD generations per day. Access to daily WOD and basic features. Unauthenticated visitors are limited to 1 WOD generation per session.
• Pro Plan: Unlimited WOD generation, saved workouts, weekly programs, and premium features as described on the pricing page. Billed monthly or annually via Stripe.

We reserve the right to modify plan limits and pricing with reasonable advance notice. Continued use of the Service after changes constitutes acceptance.

Paid subscriptions are processed by Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis. You agree to:

• Provide valid and current payment information
• Promptly update payment details to prevent service interruption

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused time unless required by applicable law.

Free Trial: If a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless cancelled beforehand.

Refund Policy: Refund requests made within 7 days of initial purchase will be evaluated on a case-by-case basis. Contact legal@wodbuilders.com with your request.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Scrape, crawl, or systematically extract content from the Service without written permission
• Circumvent usage limits through automated tools, proxies, or multiple accounts
• Attempt to gain unauthorized access to our systems, servers, or databases
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload or transmit malicious code, viruses, or any disruptive content
• Impersonate any person or entity, or misrepresent your affiliation
• Resell or redistribute generated workout content as your own commercial product without authorization

The Service, including its software, design, brand, logo, generated content, and underlying algorithms, is owned by WODBuilders and protected by applicable intellectual property laws.

Your Content: You retain ownership of any content you submit (e.g., profile data, notes). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use it to provide and improve the Service.

Generated Workouts: WODs generated through the Service are provided for your personal use. You may share individual workouts for non-commercial purposes with attribution to WODBuilders.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in accordance with the GDPR (where applicable) and other applicable privacy laws.

The Service integrates with third-party providers including:

• Supabase — database and authentication (supabase.com)
• Stripe — payment processing (stripe.com)
• PostHog — product analytics (posthog.com)

Your use of the Service is subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WODBUILDERS DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WODBUILDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $50 USD.

You agree to indemnify and hold harmless WODBuilders, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit to the Service.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 4, 8, 11, 12, and 15 survive termination.

You may delete your account at any time from your dashboard settings or by emailing legal@wodbuilders.com.

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Spain.

If you are a consumer in the European Union, you may also have the right to submit a dispute to an online dispute resolution platform: ec.europa.eu/consumers/odr.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page with an updated "Last updated" date, and where appropriate, by sending an email notification. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
